Answer to 1: It's not right to kill the innocent, and I doubt that the policemen are mandated to kill the innocent whether they are on the performance of their duty or not.
Answer to 2: Death penalty at this point is their easiest way out. Suppose we do not take the other matters into count (such as public outcry, lowered police morale, cry for human rights to justice, potential modifications to laws, etc), death penalty will be most beneficial to the government coffers.
Answer to 3: I'm not quite sure which scenario you wanna assess on whether it's fair or not.
